PROTECT TRANS CARE IN MASSACHUSETTS

In Massachusetts, every child has the right to healthcare.

Right now, hospitals across the Commonwealth are shutting their doors to trans youth, leaving families stranded without medically necessary care.‍ ‍

We are calling on Attorney General Andrea Campbell to enforce Massachusetts law, hold non-compliant providers accountable, and protect trans lives.

A protest march in an urban area with many people holding signs advocating for trans rights. The central sign reads "Trans Kids Matter" in large white letters on a background with pink, blue, and gray colors. The crowd is diverse, wearing winter clothing and face masks, and the background features a building with a large glass window and a 'T' sign indicating a transit station.

Across Massachusetts, hospitals and clinics have stopped providing gender-affirming care (GAC) to transgender youth. They are still giving these exact same treatments to cisgender kids, creating a discriminatory double standard. This sudden loss of care has had devastating effects for families and children:  We have heard devastating stories of families forced to cross state lines, or even return to hostile red states, just to seek basic medical care. Other children have had their transitions entirely disrupted because well-meaning but confused parents assumed the care was no longer safe or legal when their trusted local clinic abruptly cut off access.  Even some families who have been able to transfer their care to other providers have been placed on long waiting lists or forced to re-start a months-long clinical intake process before resuming care.

When we met with Attorney General Andrea Campbell’s office, they admitted that stopping this care is illegal under state law. This pre-emptive denial of care directly violates two foundational state laws: the Public Accommodations Law, which prohibits gender identity discrimination, and the Massachusetts Shield Law, enacted specifically to protect gender-affirming care. Even after federal courts struck down unlawful federal threats, Massachusetts providers refuse to bring it back, and the state isn't forcing them to follow the rules. When did Massachusetts become a state that protects hospitals over children?

Massachusetts laws were built to protect trans youth and stop medical discrimination, but those laws mean nothing without enforcement. Attorney General Campbell must stop protecting hospitals, do her job, and step up to enforce our civil rights laws immediately. No child should be denied medically necessary care because of who they are.

What's Happening With Trans Healthcare in MA?

Our Open Letter to the Attorney General

We are calling on Attorney General Andrea Campbell to investigate health care providers currently discriminating against trans youth and breaking Massachusetts law.

Call on providers like Fenway Health, Outer Cape Health Services, and Baystate Health to immediately resume medically necessary gender-affirming care in compliance with state law.

1. Demand Immediate Reinstatement

Launch formal inquiries into providers denying care to determine if they are violating Massachusetts anti-discrimination and consumer protection laws.

2. investigate Illegal Care Restrictions

Mandate that providers disclose key metrics on affected patients, including transition plans, referrals, and how many individuals were left stranded without care. Proactively communicate with patients who have lost care to verify providers’ metrics.

3. Expose the True Patient Impact

Unify efforts across MassHealth, the Department of Public Health, and the Governor’s Office to fix broken care pipelines and enforce real-world access.

4. Mobilize State Regulatory Power

Utilize civil rights enforcement, direct corrective action, and litigation to force non-compliant healthcare providers to restore services.

5. Deploy Full Enforcement Authority
